1 Appellant, Vernon Robert Guthrey, hereinafter referred to as defendant, was charged, tried and convicted in the District Court of Oklahoma County, Oklahoma, Case No. CRM-72-598, for the offense of Unlawful Possession of a Controlled Drug. His punishment was fixed at sixty (60) days in the County Jail, and from said judgment and sentence, a timely appeal has been perfected to this Court.
